2. Eligibility of Patients

We primarily serve Workers’ Compensation and Personal Injury (PI) patients.

All patients must have a valid prescription or authorization from a licensed medical provider before receiving devices.

By using our services, you confirm that all information you provide (including medical documentation) is accurate and up to date.
3. Device Use & Responsibility

Devices must be used only as directed by your prescribing provider and according to the instructions provided.

Apex DME Specialists is not responsible for misuse, improper handling, or modifications of devices once delivered.

Patients are responsible for proper care, return (if applicable), and safe use of devices.
4. Insurance, Billing & Payments

Coverage for devices may vary depending on Workers’ Compensation or PI case approval.

Patients and/or their representatives are responsible for providing accurate insurance and billing information.

Any denied claims or uncovered balances may become the responsibility of the patient or guarantor.
5. Warranty & Returns

All devices provided are new or patient-ready and covered by manufacturer warranties.

Defective devices may be replaced at no cost if reported within [30 days] of receipt.

Returns are accepted only for defective products or as required by law; devices cannot be returned once used due to health and safety regulations.
6. Limitation of Liability

Apex DME Specialists is not liable for any indirect, incidental, or consequential damages arising from the use of our devices or services.

Our maximum liability is limited to the cost of the device provided.
